BUREN Thesis Prize for Insolvency Law 2024 | Shortlist announced

Every year BUREN, in collaboration with Celsus Juridische Uitgeverij, awards the BUREN Thesis Prize for Insolvency Law to the best thesis on insolvency law. The jury of the BUREN Thesis Prize for Insolvency law 2024 consists of prof. mr. H. Koster (professor Company Law at Leiden University), mr. H.J. de Kloe (lecturer Insolvency Law at Erasmus University in Rotterdam) en mr. M.J.H. Vermeeren (partner and laywer at BUREN).

Following a meticulous review process, the jury has compiled the shortlist of nominees. The final winner will be announced during the awards ceremony at our office in The Hague on 26 November.

Shortlisted Nominees
The following theses have been shortlisted for the BUREN Thesis Prize for Insolvency Law 2024:

1. Laurens van de Vorst ‘Noodzaakfinanciering en de WHOA: welke reddingsboei biedt het meeste houvast voor een doorstart? Een interne rechtsvergelijking tussen twee preventieve herstructureringsinstrumenten (buiten surseance en faillissement) genaamd noodzaakfinanciering en de WHOA’
2. Derk von Saher ‘De waarde van een toezegging zonder onderbouwing. Een jurisprudentieonderzoek naar de aannemelijkheidstoets van het toezeggingsvereiste van art. 376 lid 1 Fw volgens de creditors' bargain theory’
3. Abe Lycklama ‘Balans tussen flexibiliteit en zekerheid. Een vergelijkende analyse van de absolute priority rule in Nederland en Duitsland’
4. Max Verweij ‘De (on)mogelijkheden tot het wijzigen van rechten onder de WHOA. Een onderzoek naar gedwongen doorfinanciering op het snijvlak van art. 370 lid 1 Fw en art 373 lid 1 Fw’
5. Emma Verweij ‘Third-Party releases en de WHOA. Een onderzoek naar de rechtsgeldigheid en wenselijkheid van third-party releases in het WHOA-akkoord, mede bezien vanuit Amerikaansrechtelijk perspectief’

Each nominee has made a unique contribution to the field of insolvency law, and their dissertations reflect a deep understanding of complex legal issues.

Awards Ceremony
The winner of the BUREN Thesis Prize for Insolvency Law 2024 will be announced on 26 November during a ceremony at our office in The Hague. We look forward to welcoming the winner and other nominees to celebrate their achievements.
